The central government has clarified that the state government is the competent authority to take action against IAS/IPS/IFS officer deployed in various states.
Additional Solicitor General Ashok Kumar Chakraborti, while appearing before Calcutta High Court, submitted that the Department of Personnel and Training was not the competent authority to take action against IPS/IAS/IFS officers deployed in various states.
Chakraborti submitted a circular dated 24th October by the Ministry of Home Affairs, before the court that in cases where action is to be taken against an IPS/IAS or IFS officer, the state in which the officer is serving would be competent to take such action.
The centre has submitted its response to a PIL seeking registration of an FIR against former Kolkata Police Commissioner Vineet Goyal for allegedly revealing the name of the R G Kar Medical College and Hospital rape-murder victim.
The court had sought central government's response.
Goyal, who was the Commissioner of Kolkata Police when the gruesome incident took place on August 9, is now posted as Additional Director General (ADG) of the Special Task Force (STF) of West Bengal Police.
