Mohammad Sarvar, who was acquitted in the 2008 bomb blast, has been given bail in a case of possessing live bomb during the Jaipur serial blast. Sarvar was caught by Anti Terrorist Squad (ATS) for possessing live bomb during the blast.o

High court bench of Justice Birendra Kumar granted Saravar bail after hearing arguments from Sayyed Saadat Ali, who pleaded that the accused has already been acquitted by the High Court in all the eight cases of bomb blast.

The court had summoned witnesses, who had given testimony in the Jaipur bomb blast case, to testify in the live bomb case also.

“But the court could not find any new evidence or documents from witnesses. So the court decided to grant him bail,” said Ali.

The high court on March 30 this year has acquitted Saravar and other three people accused for the 2008 Jaipur serial blasts, which killed 71 people and injured 185. The blast was linked to terror outfit Mujahideen (IM).

A division bench of justices Pankaj Bhandari and Sameer Jain had acquitted the four accused — Mohammad Saif (32), Mohammad Sarvar (36), Saif-Ur-Rahman (36), and Salman (34) — who were given capital punishment by a trial court, whose order was challenged in the high court.

The court, however had slammed the department for shoddy investigation saying“It is duty of the police/investigation agency to secure and record the complete evidence… However, in the instant case, the investigation agency has utterly failed to do so. This court has no hesitation to hold that the investigation was flawed, shoddy and there were lapses on the part of the investigation team.”

The court had directed the director general of Rajasthan Police to initiate appropriate disciplinary proceedings “against the erring officers of the Investigating team”.
