Rajasthan High Court upholds termination of RJS Pinky Meena

The has upheld the termination of judiciary officer Pinky Meena. The bench of Ashok Kumar Gaur and Justice Ashutosh Kumar, while delivering the order, rejected the petition of Pinky Meena saying that the termination order of Meena can't be considered illegal.

The order said that at every stage of Rajasthan Judiciary Service (RJS) exam, Meena had deliberately concealed the fact that she had been a teacher and despite that she had not taken NOC from education department for appearing in RJS exams.

Can't pursue two courses simultaneously

During the hearing, the High argued that when Pinky Meena was pursuing LLM from Rajasthan University, she was posted as a teacher at a government school in Sawai Madhopur. How can a person pursue a regular degree course while working as a regular government employee.

The High Court in its order contended that RJS Pinky Meena had pursued two courses – B.ED and LLB together which is not possible. As per the ordinance 168-A and 168-B of the handbook of Rajasthan University, it is impermissible to pursue two courses together. Moreover, Meena also completed LLM degree as a regular student while working as a teacher in government school. In that case as per the condition number 14 of the recruitment notice, candidature can be cancelled at any stage in the absence of NOC.

Contention of Pinky Meena

In the petition, Pinky Meena said that she had cleared RJS examination in 2017 and then was appointed as RJS trainee in 2019. A year after she was given notice in February 2020 and was later dismissed from service in May 2020 by full court. She was removed ignoring the fact that the first year of LLB is not the final examination for being awarded LLB degree. Also, classes of LLM are not being conducted in regular basis.

She further argued that there was no column of mentioning past service in the checklist during the interview of RJS. Also there was no provision in RJS exam rules of seeking NOC from department before appearing in the examination. During dismissal of her services, natural justice has been completed ignored.

Who is Pinky Meena?

Pinky Meena is a native of Bamanwas sub division in Sawai Madhopur district. She is daughter of father Sampat Ram Meena and Badam Devi of Sundari village. She is the first RJS officer from her village.
